Renting Church Property The new legislation by the Scottish Parliament
The General Trustees have reminded the Presbytery Clerks that the new legislation introduced by the Scottish Parliament regarding rental properties affects the way in which a manse is rented out in a vacancy. The changes and obligations only come into force once a tenant changes, and therefore all existing tenancy agreements do not change unless there is a change of tenants proposed.
If a manse is rented and the tenancy changes, the process is subject to the legal demands of the state.
The General Trustees give the advice that...
· when renting a manse congregations are best to use reputable local agent to deal with possible tenants and arrange the lease
· no lease should be signed on behalf of a congregation without submitting the lease for examination by the Law department. This will ensure that the lease is appropriate and protects the rights of the congregation. The Law Department will give advice and guidance so that it conforms to the requirements of civil law and caters for the possibility of the manse being used in future for the residence of a minister.
